Avec la procuration, votre avocat peut \u00e9galement s\u2019en charger.<\/p>\n<p>Si vous gardez le compte ouvert (parce que vous poss\u00e9dez d\u2019autres propri\u00e9t\u00e9s en Espagne ou que vous souhaitez le garder ouvert), il est pr\u00e9f\u00e9rable d\u2019annuler tous les pr\u00e9l\u00e8vements automatiques pour les services publics \/ les taxes locales \/ les frais communautaires, afin d\u2019\u00e9viter de recevoir toute facture future au cas o\u00f9 l\u2019acheteur ne ferait pas les changements n\u00e9cessaires aupr\u00e8s des organismes concern\u00e9s.<\/p>\n<p>Dans tous les cas, il est obligatoire d\u2019informer la communaut\u00e9 des propri\u00e9taires de la vente (et de leur fournir une copie de l\u2019acte de vente) et d\u2019informer \u00e9galement le conseil\/cadastre de la vente (bien que le notaire s\u2019en charge g\u00e9n\u00e9ralement). width=\u00a0\u00bb1\/2&Prime; tablet_width_inherit=\u00a0\u00bbdefault\u00a0\u00bb animation_type=\u00a0\u00bbdefault\u00a0\u00bb bg_image_animation=\u00a0\u00bbnone\u00a0\u00bb border_type=\u00a0\u00bbsimple\u00a0\u00bb column_border_width=\u00a0\u00bbnone\u00a0\u00bb column_border_style=\u00a0\u00bbsolid\u00a0\u00bb][vc_column_text css=\u00a0\u00bb.vc_custom_1675781770344{padding-right: 10% !important;}\u00a0\u00bb]\n<h3>3% et l\u2019imp\u00f4t sur les plus-values:<\/h3>\n<p>Lorsque le vendeur est NON RESIDENT, l\u2019acheteur a l\u2019obligation l\u00e9gale de retenir 3% du prix de vente et de le d\u00e9poser au bureau des imp\u00f4ts, pour couvrir l\u2019imp\u00f4t sur la plus-value \u00e9ventuelle de la vente.<\/p>\n<p>Le vendeur doit ensuite calculer l\u2019imp\u00f4t r\u00e9el sur les plus-values (qui est de 19% sur le b\u00e9n\u00e9fice r\u00e9alis\u00e9 sur la vente) et pr\u00e9senter le formulaire 210 :<\/p>\n<ul>\n<li>Si la CGT R\u00c9ELLE est inf\u00e9rieure aux 3% d\u00e9tenus, il peut demander le remboursement de la diff\u00e9rence.<\/li>\n<li>Si la CGT r\u00e9elle est sup\u00e9rieure aux 3 % d\u00e9tenus, il doit payer la diff\u00e9rence.<\/li>\n<\/ul>\n<p>Pour pouvoir b\u00e9n\u00e9ficier du remboursement des 3 % par le bureau des imp\u00f4ts, le vendeur doit savoir que..:<\/p>\n<ul>\n<li>Il doit \u00eatre \u00e0 jour dans le paiement de la TAXE DE NON RESIDENT pour les 4 derni\u00e8res ann\u00e9es.<\/li>\n<li>Le remboursement sera effectu\u00e9 par le bureau des imp\u00f4ts directement sur un compte au nom du vendeur, celui-ci doit donc pr\u00e9senter lors de la demande du remboursement une preuve de propri\u00e9t\u00e9 dudit compte (un relev\u00e9 bancaire ou similaire indiquant son nom en tant que titulaire et l\u2019IBAN).<\/li>\n<li>\u00a0La date limite pour le remboursement est de 10 mois A PARTIR de la date de la vente.<\/li>\n<\/ul>\n<p>Le formulaire 210 doit \u00eatre pr\u00e9sent\u00e9 dans les 4 mois suivant la date de la vente, sinon le vendeur se verra imposer des p\u00e9nalit\u00e9s de retard.<\/p>\n<p>Si le vendeur est R\u00c9SIDENT FISCAL en Espagne, alors aucun 3% n\u2019est retenu lors de la vente, mais le vendeur doit d\u00e9clarer la vente et la plus ou moins-value \u00e9ventuelle dans la pr\u00e9sentation de l\u2019imp\u00f4t sur le revenu de l\u2019ann\u00e9e suivante.<\/p>\n<p>Le calcul du b\u00e9n\u00e9fice sur la vente peut \u00eatre compliqu\u00e9, il est donc conseill\u00e9 de consulter votre avocat pour conna\u00eetre la CGT potentielle \u00e0 payer (le cas \u00e9ch\u00e9ant).[\/vc_column_text][\/vc_column][vc_column column_padding=\u00a0\u00bbno-extra-padding\u00a0\u00bb column_padding_tablet=\u00a0\u00bbinherit\u00a0\u00bb column_padding_phone=\u00a0\u00bbinherit\u00a0\u00bb column_padding_position=\u00a0\u00bball\u00a0\u00bb column_element_direction_desktop=\u00a0\u00bbdefault\u00a0\u00bb column_element_spacing=\u00a0\u00bbdefault\u00a0\u00bb desktop_text_alignment=\u00a0\u00bbdefault\u00a0\u00bb tablet_text_alignment=\u00a0\u00bbdefault\u00a0\u00bb phone_text_alignment=\u00a0\u00bbdefault\u00a0\u00bb background_color_opacity=\u00a0\u00bb1&Prime; En th\u00e9orie, il est calcul\u00e9 sur l\u2019augmentation de la valeur du terrain sur lequel la maison est construite, depuis son acquisition jusqu\u2019\u00e0 sa vente, mais dans la pratique, son calcul d\u00e9pend de formules compliqu\u00e9es sur la valeur cadastrale du terrain.<\/p>\n<p>Lorsque le vendeur est NON R\u00c9SIDENT, l\u2019acheteur peut \u00eatre contraint de le payer au cas o\u00f9 le vendeur ne le paierait pas, donc dans la pratique, l\u2019acheteur d\u00e9tiendra \u00e9galement le montant n\u00e9cessaire pour couvrir son paiement \u00e0 partir du prix de vente.<\/p>\n<p>Si le vendeur est R\u00c9SIDENT FISCAL en Espagne, l\u2019acheteur ne sera pas responsable de son paiement et aucune somme ne sera retenue sur le prix de vente, mais dans tous les cas, le vendeur doit le payer.<\/p>\n<p>Des jugements r\u00e9cents de diff\u00e9rents tribunaux ont d\u00e9termin\u00e9 que dans le cas o\u00f9 une propri\u00e9t\u00e9 est vendue pour un montant inf\u00e9rieur au prix d\u2019achat, la taxe de Plus-value ne peut pas \u00eatre r\u00e9clam\u00e9e par la mairie.
